TEXICO YOUTH SPORTS WAIVER AND LIABILITY RELEASE

In consideration of being allowed to participate in any way in the Texico Youth Sports Association athletic sports program, related events and activities, the undersigned acknowledges, appreciates, and agrees that:

  1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

  2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

  3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

  4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Texico Youth Sports Association their directors, officers, officials, agents, volunteers and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

THE TEXICO MUNICIPAL SCHOOLS (“SCHOOL DISTRICT”) ALLOWS COMMUNITY GROUPS TO USE SCHOOL DISTRICT FACILITIES PURSUANT TO A SITE USE AGREEMENT AND STATE REGULATIONS THAT REQUIRE PARTICIPANTS TO GIVE WAIVERS OF LIABILITY AND RELEASES FOR PERSONAL INJURY OR PROPERTY DAMAGE, AND TO ASSUME THE RISK OF PARTICIPATION. THE UNDERSIGNED UNDERSTANDS THAT THE ACTIVITY IS NOT A PROGRAM OR EVENT SPONSORED BY THE SCHOOL DISTRICT. IT IS EXPECTED THAT NO DISTRICT EMPLOYEE OR AGENT WILL BE PRESENT DURING THE ACTIVITY. THE ACTIVITY MAY BE SUPERVISED BY PERSONS UNRELATED TO THE SCHOOL DISTRICT AND/OR BY PERSONS WHO HAVE NOT BEEN SUBJECT TO A BACK-GROUND CHECK PROVIDED TO THE SCHOOL DISTRICT. IT IS A CONDITION OF THE USE OF THE SCHOOL DISTRICT FACILITY THAT ALL PARTICIPANTS SIGN THIS FORM ACKNOWLEDGING THAT THE SCHOOL DISTRICT IS NOT RESPONSIBLE FOR SUPERVISION, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE OCCURRING AT THE SCHOOL DISTRICT FACILITY OR RELATED TO THE ACTIVITY. YOU ALSO AGREE, ON BEHALF OF ANY UNDERAGE CHILDREN, THAT IT IS YOUR RESPONSIBILITY TO ENSURE THAT THE CHILD ARRIVES HOME SAFELY AFTER THE ACTIVITY.

By signing below, you (each participant or guest) agree that if you engage in any physical exercise or activity, or use any facility or equipment on the School District premises, you do so ENTIRELY AT YOUR OWN RISK. You agree that you are voluntarily participating in the use of this facility and ASSUME ALL RISKS of injury, illness, or death or loss or damage to personal property.


By signing below, you (each participant or guest) acknowledge that you are solely responsible for all damages caused by accidental, negligent, or wrongful acts towards School District facilities, property, or equipment. You agree to replace, at your own expense for all losses, breakage, or damage that occurs during open gym hours. You agree that you will not seek to access any areas of the School District other than the facility the activity is authorized to use.

By signing below, I acknowledge that I have carefully read this waiver and release and fully understand that it is a release of liability. I, on behalf of my heirs, successors and assigns, expressly agree to release and discharge the School District, its School Board, Board members, employees and agents from any and all claims or causes of action and hereby agree to voluntarily give up or waive any right that may otherwise have to bring a legal action against the School District, its School Board, Board members, employees and agents for negligence, personal injury, property damage, or for any other loss or injury.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOLLOW THE GOLDEN RULE – Always treat others (coaches, parents, officials, players, opposing fans, and facilities) the same way you would want you and your child, your friends, your home, and school to be treated.  Please set the example by showing respect, dignity and total sportsmanship at all times.

 

BE RESPONSIBLE – Please have your kids to practice and games on time.  Make sure they have their uniform and sneakers.  Help them eat and drink right before, during and after the game. Please check for belongings and trash after all practices and games.

 

BE SEEN, NOT HEARD – Nothing is better for a young player than having their parents on hand to watch them play.  And nothing is worse for a player than hearing a parent booing, taunting, screaming or making comments at, or about, players, coaches, fans or officials.  Offer applause of encouragement for both teams following a good play or a great effort, otherwise keep quiet.  Avoid “coaching” your child and the other children from the stands unless you are one of the official coaches.  This just stresses the kids out and makes the games and practices no fun for anyone.

 

DON’T QUESTION AN OFFICIAL’S CALL – You may not agree with a call, but it’s not your job (or the players or coaches either) to officiate the game.  Never should an official’s call be argued by anyone.  Please accept the call and move on.

 

POSTERS AND POSTING – Positive signs/posters can be made to motivate teams’ effort.  Students and parents will not degrade, demean, or belittle any competitor, teammate, coach, administrator,  fellow student, or any other individual through the means of any social media outlet.

 

IF YOU MUST, TALK WITH THE COACH AFTER THE GAME – 24 HOURS AFTER THE GAME! – Never make a scene in front of the team as it’s embarrassing for you, your children and the coach.  Cool off.  If you would like to discuss a concern, an appointment must be scheduled with either the coach or the board president at least 24 hours following a game.

 

PRACTICE MAKES PERFECT – Your kids need to see you take an interest in what they are doing.  Right now, playing with Texico Youth Sports is a major event in their lives.  Practice the fundamentals of basketball with them as much as possible.  Practice dribbling, shooting, passing, rebounding and defense with them over and over again.  Teams have one, maybe two, practices a week, and there is only so much coaches are able to fit into those practices.

 

IT’S SUPPOSED TO BE FUN – So please help make it that way.  Keep smiling:)  Avoid the post game analysis.  Encourage enjoyment and participation over results.  If it’s not fun, something is wrong.  We are still just in the stages of learning fundamentals.  

 

KNOW THE RULES – Know the rules of the game. Failure to adhere to this code of conduct could include, but are not limited to the following:

3. Removal for the remainder of season.

CONCUSSION SAFETY AND AWARENESS


This section has information to help protect your children or teens from concussion or other serious brain injury. Use this information at your children’s or teens’ games and practices to learn how to spot a concussion and what to do if a concussion occurs.

WHAT IS A CONCUSSION?

A concussion is a type of traumatic brain injury—or TBI—caused by a bump, blow, or jolt to the head or by a hit to the body that causes the head and brain to move quickly back and forth. This fast movement can cause the brain to bounce around or twist in the skull, creating chemical changes in the brain and sometimes stretching and damaging the brain cells.


HOW CAN I HELP KEEP MY CHILDREN OR TEENS SAFE?

Sports are a great way for children and teens to stay healthy and can help them do well in school. To help lower your children’s or teens’ chances of getting a concussion or other serious brain injury, you should:

  • Help create a culture of safety for the team.
  • Work with their coach to teach ways to lower the chances of getting a concussion.
  • Talk with your children or teens about concussion and ask if they have concerns about reporting a concussion. Talk with them about their concerns; emphasize the importance of reporting concussions and taking time to recover from one.
  • Ensure that they follow their coach’s rules for safety and the rules of the sport.
  • Tell your children or teens that you expect them to practice good sportsmanship at all times.
  • When appropriate for the sport or activity, teach your children or teens that they must wear a helmet to lower the chances of the most serious types of brain or head injury. However, there is no “concussion-proof” helmet. So, even with a helmet, it is important for children and teens to avoid hits to the head.

HOW CAN I SPOT A POSSIBLE CONCUSSION?

Children and teens who show or report one or more of the signs and symptoms listed below—or simply say they just “don’t feel right” after a bump, blow, or jolt to the head or body—may have a concussion or other serious brain injury.

Signs Observed by Parents or Coaches

  • Appears dazed or stunned.
  • Forgets an instruction, is confused about an assignment or position, or is unsure of the game, score, or opponent.
  • Moves clumsily.
  • Answers questions slowly.
  • Loses consciousness (even briefly).
  • Shows mood, behavior, or personality changes.
  • Can’t recall events prior to or after a hit or fall.

Symptoms Reported by Children and Teens

  • Headache or “pressure” in head.
  • Nausea or vomiting.
  • Balance problems or dizziness, or double or blurry vision. 
  • Bothered by light or noise.
  • Feeling sluggish, hazy, foggy, or groggy.
  • Confusion, or concentration or memory problems.
  • Just not “feeling right,” or “feeling down.”

Talk with your children and teens about concussion. Tell them to report their concussion symptoms to you and their coach right away. Some children and teens think concussions aren’t serious or worry that if they report a concussion they will lose their position on the team or look weak. Be sure to remind them that it’s better to miss one game than the whole season.

Concussions affect each child and teen differently. While most children and teens with a concussion feel better within a couple of weeks, some will have symptoms for months or longer. Talk with your children’s or teens’ health care provider if their concussion symptoms do not go away or if they get worse after they return to their regular activities.

WHAT ARE SOME MORE SERIOUS DANGER SIGNS TO LOOK OUT FOR?

In rare cases, a dangerous collection of blood (hematoma) may form on the brain after a bump, blow, or jolt to the head or body and can squeeze the brain against the skull. Call 9-1-1 or take your child or teen to the emergency department right away if, after a bump, blow, or jolt to the head or body, he or she has one or more of these danger signs:

  • One pupil larger than the other.
  • Drowsiness or inability to wake up.
  • A headache that gets worse and does not go away.
  • Slurred speech, weakness, numbness, or decreased coordination.
  • Repeated vomiting or nausea, convulsions or seizures (shaking or twitching).
  • Unusual behavior, increased confusion, restlessness, or agitation.
  • Loss of consciousness (passed out/knocked out). Even a brief loss of consciousness should be taken seriously.


Children and teens who continue to play while having concussion symptoms or who return to play too soon—while the brain is still healing— have a greater chance of getting another concussion. A repeat concussion that occurs while the brain is still healing from the rst injury can be very serious and can a ect a child or teen for a lifetime. It can even be fatal.

What Should I Do If My Child or Teen Has a Possible Concussion? As a parent, if you think your child or teen may have a concussion, you should:

  1.  Remove your child or teen from play.
  2. Keep your child or teen out of play the day of the injury. Your child or teen should be seen by a health care provider and only return to play with permission from a health care provider who is experienced in evaluating for concussion.
  3. Ask your child’s or teen’s health care provider for written instructions on helping your child or teen return to school. You can give the instructions to your child’s or teen’s school nurse and teacher(s) and return-to-play instructions to the coach and/or athletic trainer.


Do not try to judge the severity of the injury yourself. Only a health care provider should assess a child or teen for a possible concussion. Concussion signs and symptoms often show up soon after the injury. But you may not know how serious the concussion is at rst, and some symptoms may not show up for hours or days. The brain needs time to heal after a concussion. A child’s or teen’s return to school and sports should be a gradual process that is carefully managed and monitored by a health care provider.

I hereby give consent to Texico Youth Sports Association (the “association”) to photograph, videotape, or otherwise digitally record and use images and/or sound recordings of myself or my child or children (if applicable) to use in any public media, including radio, television, internet, social media, print or in any of the association's or its partners’ publications, productions, or posts. I understand that the intended use of such images and information is solely for the purpose of advertising, marketing, fundraising and/or the promotional and public awareness purposes for the association. I hereby waive any rights or interest in the images or recordings, as contemplated in this release. I acknowledge that this consent to use images and/or recordings is being made solely for the benefit of the association and comes without any expectation of monetary compensation or other benefit to me. To the extent that any benefit accrues or might accrue to the association from the use of images or information, I hereby and forever waive any interest in or claim to such benefits. I hereby release and forever discharge the association (including without limitation all corporate affiliates and officers, directors, trustees, donors, employees, agents and volunteers) from any and all claims, liability, actions, suits, demands, costs, expenses or indebtedness arising out of, related to, or in any way connected with the use of images and materials described herein, and I hereby waive all rights and interest in and to such information and materials. REFUND POLICY


Refunds will not be issued once uniforms have been ordered. Any registration service fees will not be refunded.  In case of a government mandated shut down refunds will be reviewed and will be dependent on length of season and purchases made for the season including jersey purchases.

I/We hereby consent the above player to participate in this USSSA Baseball program during the upcoming season. I will assume all risks and hazards that are incidental in participating in these activities.
